DMCA Policy

The Imperial Chamber of Commerce (“we,” “our,” “us”) respects the intellectual property rights of others and expects users of our website https://imperialchamber.com/ (“Website”) and services to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have adopted the following policy regarding copyright infringement.

1. Notification of Infringement Claims

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our Website, please notify our designated Copyright Agent with the following information:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
  • Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an email address at which the complaining party may be contacted.
  • A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Response to Infringement Claims

Upon receipt of a valid DMCA notice, we will:

  • Remove or disable access to the allegedly infringing material.
  • Take reasonable steps to notify the user who posted the material that we have removed or disabled access to the material.
  • If the user believes that the material is not infringing, they may send a counter-notification to our Copyright Agent.

4. Counter-Notification

If you believe that your material was removed or disabled by mistake or misidentification, you may submit a written counter-notification to our Copyright Agent with the following information:

  • A physical or electronic signature of the user.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  • The user’s name, address, telephone number, and, if available, email address.
  • A statement that the user consents to the jurisdiction of the Federal Court for the judicial district in which the user’s address is located, or if the user’s address is outside the United States, for any judicial district in which the service provider may be found, and that the user will accept service of process from the person who provided the original notification or an agent of such person.

Upon receipt of a valid counter-notification, we will:

  • Promptly provide the person who sent the original notification with a copy of the counter-notification.
  • Inform that person that we will replace the removed material or cease disabling access to it within 10 business days.
  • Replace the removed material or cease disabling access to the material within 10 to 14 business days following receipt of the counter-notification, provided our Copyright Agent has not received notice from the original complaining party that a court action has been filed to restrain the user from engaging in infringing activity related to the material on our Website.

5. Repeat Infringers

We may, at our discretion, terminate the accounts of users who are repeat infringers.

6. Changes to DMCA Policy

We reserve the right to amend this policy at any time. Any changes will be effective immediately upon posting the revised policy on our Website. Your continued use of our services following the posting of changes to this policy means that you accept and agree to the changes.
